Terms & Conditions: AVILOO EV Battery Test Service

1. Service Definition & Scope

   The Service: paultan.org ("The Company") acts as an authorized dealer and facilitator for the AVILOO Battery Diagnostic Service ("The Test").

   Third-Party Technology: The Customer acknowledges that the testing hardware (AVILOO Box), software, algorithms, and final reports are proprietary technologies provided by Aviloo GmbH ("The Manufacturer").

   Nature of Report: The resulting Battery Certificate is a diagnostic snapshot of the battery's health at the specific time of testing. It is not a warranty, guarantee of future performance, or an insurance policy for the vehicle.

2. Disclaimer of Accuracy & Warranties

   No Guarantee of Results: While The Company strives to ensure the test is conducted correctly, we do not warrant the accuracy, completeness, or reliability of the data generated by AVILOO’s algorithms.

   "As-Is" Basis: The report is provided on an "as-is" basis. The Company is not liable for any discrepancies between the AVILOO report and the vehicle manufacturer’s stated State of Health (SoH) or future battery failure.

   Exclusion of Liability for Vehicle Value: The Company is not responsible for any loss in vehicle resale value, failed sale negotiations, or financial losses resulting from a "Poor" or "Red Flag" test result.

3. Customer Obligations & Safety (Critical Clause)

   Driving Risks (For Premium Test): The Customer acknowledges that the "Premium Test" requires driving the vehicle from 100% to 10% State of Charge (SoC). The Customer assumes full responsibility for:

   • Safe operation of the vehicle during the test cycle.
   • Compliance with all traffic laws.
   • Ensuring the vehicle does not run out of power completely (stranded vehicle).

   Indemnity: The Customer agrees to indemnify and hold harmless paultan.org from any claims, accidents, towing costs, or traffic violations occurring during the test drive.

   Vehicle Condition: The Customer warrants that the vehicle is roadworthy and insured before commencing the test.

4. Limitation of Liability

   Hardware Connection: The Customer acknowledges that plugging third-party devices (AVILOO Box) into the vehicle is done at their own risk. The Company is not liable for any electrical faults, error codes, or ECU issues that may arise during or after the connection of the AVILOO Box.

   Liability Cap: To the maximum extent permitted by law, The Company's total liability for any claim arising out of this service shall be strictly limited to the price paid by the Customer for the test.

5. Hardware Responsibility (If renting/loaning the AVILOO Box dongle – applicable for PREMIUM Test only)

   Deposit: A fully refundable deposit of RM800 is required for the AVILOO PREMIUM Test, as the device will be installed in the test vehicle for several days. The deposit will be returned once the AVILOO Box is returned in good condition.

   Equipment Care: The AVILOO Box remains the property of paultan.org (unless purchased outright). The Customer is responsible for the device while in their possession.

   Loss or Damage: If the unit is lost, stolen, or damaged, the Customer will be charged a replacement fee of RM2,000.

   Late Return: A penalty of RM100 per day will apply if the device is not returned within 5 days of the test completion.

6. Personal Data Protection (PDPA)

   Data Transfer: The Customer consents to the collection of vehicle data (VIN, mileage, battery telemetry) and personal contact details.

   International Transfer: The Customer explicitly agrees that this data will be transmitted to Aviloo GmbH servers (located in the European Union) for processing and analysis to generate the certificate.

7. Service Fulfilment & Location

   Upon successful completion of the online payment, the Customer is entitled to receive the Service at the Company's designated facility located at K3-3A-02, Tower 3, UOA Business Park, Glenmarie, 40150 Shah Alam, Selangor. The Company reserves the right to refuse service if valid proof of payment is not presented upon arrival.

Refund & Cancellation Policy

(For AVILOO EV Diagnostics Service)

1. Cancellations & "Change of Mind"

   • Before plugging in diagnostics: If you wish to cancel your booking before the AVILOO Box diagnostics start, you are entitled to a full refund.
   • After diagnostics: Strictly NO REFUNDS

2. Failed Tests due to User Error

   The AVILOO PREMIUM Test requires specific driving conditions (discharging from 100% down to 10%).

   • If the test fails because the driver did not follow the instructions (e.g., stopping the test too early, not charging to 100% initially), no refund will be issued.
   • However, we may offer a one-time re-test at a discounted rate to cover the administrative and logistics costs.

3. Failed Tests due to Technical Issues

   • Hardware Defect: If the AVILOO Box is found to be defective, a full refund will be issued.
   • Data/Software Error: In the rare event that the AVILOO backend fails to generate a report due to a server or algorithm error, the customer is entitled to a free re-test or a full refund.

4. Non-Refundable Scenarios

   Strictly NO REFUNDS will be issued in the following circumstances:

   • The Test Result: You are paying for the diagnostic service, not a specific result. If the report shows your battery health is poor (e.g., 70% SoH), you cannot request a refund. The service has been successfully delivered.

5. Refund Processing Time

   • Approved refunds will be processed within 7-14 working days via the original payment method.

6. Deposit

   • A fully refundable deposit of RM800 is required for the AVILOO PREMIUM Test, as the device will be installed in the test vehicle for several days. The deposit will be returned once the AVILOO Box is returned in good condition.
