Act of Terrorism

Prior to the Extension Act, federal participation was triggered by an act of terrorism that resulted in aggregate property and casualty insurance losses of more than $5 million.

"It is haram for a Muslim to cooperate with any individual or group that is involved in any act of terrorism or violence."

We all know now that an act of terrorism has the ability to be catastrophic, with losses even greater than a windstorm, flood or earthquake.

In an effort to maintain control over the litigation process, TRIA preempts all state causes of action of any kind for property damage, personal injury, or death arising out of or resulting from an act of terrorism. Once the Secretary of the Treasury makes a determination that an act of terrorism has occurred, an exclusive federal cause of action arises for property damage, personal injury, and death arising out of or relating to the act.

The Act created a partial reinsurance mechanism for losses associated with an "act of terrorism" (as defined in the Act); nullified previous terrorism exclusions on existing insurance policies (to the extent they excluded an "act of terrorism" as defined in the Act); required participating insurers to provide specific, limited, coverage; and imposed a new set of duties upon the insurance industry.

The "certified" act of terrorism These three elements (availability, disclosure and federal participation) only relate to "acts of terrorism" as defined in the Act.

1) leading to the arrest or conviction, in any country, of any individual or individuals for the commission of an act of terrorism against a U.S.

If the legislation stopped there, it would render every march, every petition, every silent act of protest against abortion an act of terrorism. Indeed it would render any political lobbying an act of terrorism.

In their statements, they termed the attack a barbaric and gruesome act of terrorism and expressed heartfelt grief and sorrow over the loss of precious lives, said a press release.
