The PML-N leader had requested the ECP to dismiss the plea, arguing that there was no restriction in the Constitution and Election Act on a
convicted person holding a party's vice presidency.
The Mechanism for International Criminal Tribunals told BIRN that its rules stipulate that a
convicted person should be transferred to serve his or her sentence as soon as possible, but that there is no deadline.
He held opposition is at liberty to stage protest but we will not allow a
convicted person to organize public gatherings or rallies.
Instead, the suspension continues for months while the
convicted person remains free to talk whatever he wants.
In her reply, Maryam Nawaz said there is no restriction in the Constitution and Election Act on a
convicted person to hold a party's vice presidency.
Bukhari stressed being a
convicted person; Maryam cannot hold any party office.
The Public Prosecution may offer the
convicted person, if need be and upon his request, a period of time for the payment of amounts due to the State, or permit him to pay them in instalments, provided that the period does not exceed three years.
Commenting on PML-N leader Nawaz Sharif's return to jail, she said it was unfortunate that a
convicted person was going back to jail with such pump and show by his party.
Any
convicted person jailed for a year or less may request the judge to substitute it for an alternative punishment and it is up to the judge to decide on the request.
He further said the
convicted person could not leave the country as it was against the a law.
He said above 60 grams, the
convicted person would receive a fine of not more than P500 000 or 10 years' imprisonment or both.
